COLLABORATING TO ADDRESS THE NEW FEDERAL RULES OF CIVIL PROCEEDURE (FRCP) AND THEIR IMPACT ON DISCOVERY AND ELECTRONICALLY STORED INFORMATION (ESI) Date & Time: Monday August 6, 2007 9 AM The revised Federal Rules of Civil Procedure (FRCP) regarding electronic discovery, which went into effect December 1, 2006, make it essential for all organizations to have a sound, legally defensible records and information program in place. The revised FRCP clarify the scope of what can be "discovered" to include all "electronically stored information" (ESI)-not just what was traditionally defined as a "document" or "data compilation." This means that any information stored on any media type is now equally subject to legal discovery-requiring a holistic approach that takes into account both hardcopy and electronic processes. These new rules point to the need for cross-functional collaboration by RIM, IT, Legal, and Security to help locate, preserve, protect, and, when necessary, produce ESI in federal civil litigation. Many state courts are revising their rules to reflect these federal revisions. The US Department of Justice also is following similar processes for ESI with respect to government investigations. If information is not properly managed, your organization will be at even greater risk for court sanctions and legal judgments. ARMA International and the SNIA End-User Council present this workshop to help your organization specifically assess and address the e-discovery issues that put your organization at risk.
